About
A Divorce & Family Law Specialist Combining Doctoral Depth with Court Practice
Dr. Jasdeep Kaur is a New Delhi advocate whose practice is centred on divorce and
family law — matrimonial disputes, child custody and visitation, maintenance, and
domestic violence matters. Her doctorate in Family Law and published research on
maintenance rights and domestic violence sit behind the practical advice she gives,
and she also accepts instructions in civil litigation, criminal defence, corporate
matters, and legal and taxation consultation.
Family matters demand more than a reading of the statute: they demand an understanding
of the people involved. Her academic research in family law, together with experience
as a Law Officer for the Government of the National Capital Territory of Delhi and
contributions to child welfare initiatives, informs how each matter is analysed and
how sensitively it is handled.
Legal advice is only as sound as the understanding of the facts behind it — which is
why research, careful listening and clear communication sit at the centre of the work.

Questions
Frequently Asked Questions
Can you help with a divorce, even if my spouse does not agree?
Enquiries about divorce are welcome, whether or not the divorce is agreed. There are
two broad routes: divorce by mutual consent, where both spouses agree to dissolve the
marriage and its terms; and contested divorce, where one spouse petitions the court
on grounds recognised by law and the other may contest it. The right route depends on
the facts of the marriage, and those are discussed at a consultation.
Whether a particular matter can be taken up depends on its facts, the applicable law
and professional engagement.
What happens to the children in a divorce?
Questions of custody, guardianship, visitation and access are decided by the court on
the guiding principle of the welfare of the child — not on the wishes of either
parent alone. Arrangements can be agreed between parents or determined by the court
where agreement is not possible.
Matters involving children are handled with attention to their welfare and to
confidentiality, informed by doctoral research in family law and work with child
welfare initiatives.
Am I entitled to maintenance or alimony?
Maintenance for a spouse — and for children — can be sought during matrimonial
proceedings and, in some circumstances, independently. The court considers factors
such as the means of the spouses, the standard of living during the marriage and the
needs of any children. Entitlement is never assumed in advance; it depends on the
facts and the applicable law.
Maintenance rights are also an area of published research, so the practical advice is
grounded in a close study of how courts approach these claims.
I am facing domestic violence. What can the law do for me?
The law provides civil protections — including protection, residence and monetary
reliefs — alongside related remedies. Maintenance claims can accompany these. What is
appropriate in your case depends on your circumstances, and the options are best
discussed privately and in confidence.
If you are in immediate danger, please contact the police first. Legal remedies work
alongside, not instead of, immediate protection.
What documents should I prepare before a consultation?
It helps to have a short written summary of events in date order, and copies of any
relevant documents — for matrimonial matters, typically the marriage certificate,
evidence of residence and income details, and any notices or court papers already
received.
Please do not send original documents or confidential material in an initial enquiry.
Bring or share them only once an engagement has been confirmed.
How can I request a consultation?
You may submit the enquiry form in the contact section, call or send a WhatsApp
message on the number listed there, or write to the professional email address
given. Please share a brief outline of the matter and the best way to reach you.
A consultation is arranged only after the enquiry has been reviewed and terms of
engagement have been agreed.
Is my enquiry confidential?
Enquiries are treated professionally and with discretion. Please note that sending an
enquiry through this website, by email or by message does not by itself create an
advocate–client relationship; that relationship arises only when the matter has been
accepted and the terms of engagement have been agreed. Until then, information shared
is not protected by professional privilege in the same way as information provided
under a confirmed engagement.
For that reason, please keep an initial enquiry brief and do not include original
documents or highly sensitive material.
Does the website provide legal advice?
No. The content of this website is general professional information only and is not
legal advice. Legal advice depends on the specific facts of a matter and the law
applicable to it.
Please do not rely on anything on this website as a substitute for advice on your own
circumstances.
